Request to disapply regulations

Use this digital form service to ask the Department for Education (DfE) for permission to depart from school and early years funding regulations in exceptional circumstances.

You must submit a formal request if your local funding arrangements do not comply with, or may conflict with the:

Updated publications for 2027 to 2028 period will be available in due course.

A disapplication allows the DfE Secretary of State to consider whether specific regulations or grant conditions can be set aside for your local authority.

Before you apply, you must:

  • consult any schools that will be affected
  • seek views and where appropriate consult your local Schools Forum

What you can apply for:

General (schools and central school services)
General disapplications are used where you wish to depart from schools funding regulations or conditions of grant because local circumstances cannot be adequately addressed through the standard funding arrangements. Requests may relate to exceptional cost pressures, variations in pupil numbers, technical adjustments to local funding arrangements, or other specific circumstances requiring regulatory flexibility.

Schools block movement
You can transfer up to and including 0.5% of the schools block into another block, with schools forum approval. For a transfer exceeding 0.5%, or without schools forum approval you must submit a disapplication request to the Secretary of State using this form.

High Needs
High Needs disapplications are used where you wish to depart from the high needs funding arrangements set out in the funding regulations or conditions of grant. Requests may relate to high needs funding variation, post 16 extension or special school mininmum funding guarantee (MFG) exclusion.

Early years - pass through 97% only
You may submit a disapplication request where you wish to use a pass through rate lower than the level required by the early years funding regulations of 97%.

Early years - all others (not related to pass through)
This category covers any early years (EY) disapplications that do not relate to pass through requirements, including requests concerning central spend.
